Please read these Terms of Use (“Terms,” “Terms of Use”) carefully before using the www.hickoryhouse.com, and the various related websites, networks and other services on which a link to these Terms of User is displayed (collectively, the “Website”).  The Website is a complimentary information service offered by Hickory Recovery Network at no charge to users of the World Wide Web, with the express condition that these users agree to be bound by the Terms of Use set forth in these Terms of Use. Hickory Recovery Network reserves the right to change these Terms of Use any time, and you must consult the most recent version of these Terms of Use (not an older cached version) each time you view the Website. Use of the Website constitutes your acceptance of all of the following Terms of Use, including our Privacy Policy.

User Content

By posting or publishing User Content, you grant Hickory Recovery Network a right and license to host, store, transfer, display, reproduce, modify and distribute your User Content, in whole or in part, in any media formats and through any media channels, without requirement of any compensation paid to you.

We reserve the right to remove any messages or solicitations that do not meet the standards of these Terms of Use, and to immediately terminate a user’s access or registration if we become aware and determine that the user is violating any of these Terms of Use or any of the chat and discussion board guidelines as enumerated therein.  Commercial solicitation, chain letters, junk mail, “spam”, non-commercial or bulk solicitation, and/or content that infringes the copyrights or rights of privacy or publicity of others are all prohibited.  Threatening, harassing, libelous, defamatory, vulgar, profane, obscene, abusive, harmful, sexually oriented, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature, is prohibited.  Unlawful material, or any material that encourages or promotes conduct that constitutes a criminal offense, or might give rise to civil liability or otherwise violate any applicable local, state, Federal or international law or regulation, or encourage the use of controlled substances, is prohibited. Notwithstanding anything else contained in these Terms of Use, we are under no obligation to edit or control User Content that you or other users post or publish and will not be in any way responsible or liable for User Content.  In using the Website you may be exposed to User Content from a variety of sources and that User Content may contain matter that is inaccurate, offensive, indecent or objectionable.  You acknowledge and agree to waive any legal or equitable rights or remedies you may have against Hickory Recovery Network with respect to User Content.  We expressly disclaim any and all liability in connection with User Content.

Limitation Of Liability

You agree that you will hold harmless Hickory Recovery Network and its officers, directors, employees, representatives and volunteers from all claims arising out of or related to your access or use of, or your inability to access or use, the Website. This includes, but is not limited to, information or materials viewed or downloaded from this Website or another website to which it is linked that appear to you to be or may otherwise be construed as obscene, offensive, defamatory, inaccurate, incomplete, or in violation of any proprietary right. Hickory Recovery Network will terminate without notice the accounts of users that are determined by Hickory Recovery Network to have been notified of infringing activity more than twice or have had User Content removed from the Website more than twice.

Hate Speech Policy

Hickory Recovery Network does not condone or offer a platform for hate speech.  We will not tolerate it or permit its use on platforms of ours.  We reserve the right to delete or refuse to permit language that we find offensive. This includes, but is not limited to, any or all references that in our judgment are derogatory to people of any race, class, ethnicity, culture, gender, age, profession, orientation, or any population category included in state or federal civil rights legislation, whether or not the language or terms used may have been considered acceptable at some other time, in some other place, or by some other population. It also includes any language that would incite people toward violence toward or harassment of others.

You acknowledge that the opinions and recommendations contained in this Website are not necessarily those of Hickory Recovery Network or endorsed by Hickory Recovery Network. Hickory Recovery Network may provide links on the Website to other websites which are not under the control of Hickory Recovery Network. These links are provided for convenience of reference only and are not intended as an endorsement by Hickory Recovery Network of the organization or individual operating the other websites or a warranty of any type regarding the websites or the information on the websites.

Content Usage Policy

Unless otherwise indicated, all information contained on the Website, including but not limited to visual interfaces, design, text, information, data, graphics, logos, button icons, photographs, video or audio clips, computer code, services, and all other elements of the Website (collectively, the “Materials”) are copyrighted by and proprietary to Hickory Recovery Network or owned by and provided by one of our partners or affiliates and are protected by all relevant intellectual and proprietary rights and applicable laws.  Materials may not be copied, reproduced, transmitted, displayed, performed, distributed, sublicensed, altered, stored for subsequent use or otherwise used in whole or in part any manner without Hickory Recovery Network’s prior written consent (or the written consent of our partners), except that the user may make such temporary copies in a single computer’s RAM and hard drive cache as are necessary to browse the Website, and the user may make one permanent copy of each page of the Website, brochure or booklet to be used by the user for personal and noncommercial uses. Unless language on our Website expressly permits certain copying or sharing rights of particular downloadable materials, to obtain written consent to use any material on or accessible through our Website, you will need to receive our consent through a permissions agreement. Data scraping or web crawling of the Website, other than by search engines for purposes of indexing for search purposes in the ordinary course, is prohibited.

Disputes arising under these Terms of Use will be resolved in accordance with the Terms of Use in effect at the time the dispute arose.

Governing law

These Terms of Use shall be governed by the laws of the State of Indiana without regard to conflict of law principles.  To the extent that any lawsuit or court proceeding is permitted hereunder, you agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Marion County, Indiana for the purpose of litigating all such disputes.  We operate the Website from our offices in Indiana and we make no representation that Materials included in the Website are appropriate or available for use in other locations.

Dispute Resolution

Any dispute or claim relating in any way to your use of the Website or any feature of the Website will be resolved by binding arbitration, rather than in court.  There is no judge or jury in arbitration, and court review of an arbitration award is limited.  However, an arbitrator can award on an individual basis the same damages and relief as a court, and must follow these Terms of Use as a court would.  YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS OF USE, YOU AND HICKORY RECOVERY NETWORK ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.  Notwithstanding the foregoing, both you and Hickory Recovery Network agree that nothing herein will be deemed to waive, preclude or otherwise limit either party’s right to (a) bring an individual action in small claims court; (b) pursue enforcement actions through applicable federal, state or local agencies where available; (c) seek injunctive relief in a court of law; or (d) file suit in a court of law to address intellectual property infringement claims.  Any arbitration hereunder will be governed by the rules of the American Arbitration Association.  A party who intends to seek arbitration must first send a written notice of the dispute by certified mail or nationally recognized overnight delivery courier (signature required) or, in the event that we do not have a physical address on file for you and cannot obtain one, by electronic mail.  Hickory Recovery Network’s address for such notice is 3960 Southeastern Ave., Indianapolis, IN, 46203.  The notice must describe the nature and basis of the claim and set forth the specific relief sought.

Miscellaneous

These Terms of Use, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and Hickory Recovery Network regarding your use of and access to the Website.  You may not assign or transfer these Terms of Use or your rights hereunder, ion whole or in part, without our prior written consent.  Use of section headers in these Terms of Use is for convenience only and shall not have any impact on the interpretation of this agreement.  In the event that any part of these Terms of use is held to be invalid or unenforceable, the unenforceable part shall be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect.
