The Website is a complimentary information service offered by Hickory Recovery Network at no charge to users of the World Wide Web, with the express condition that these users agree to be bound by the Terms of Use set forth in these Terms of Use. Hickory Recovery Network does not condone or offer a platform for hate speech. We will not tolerate it or permit its use on platforms of ours. We reserve the right to delete or refuse to permit language that we find offensive. Governing law
These Terms of Use shall be governed by the laws of the State of Indiana without regard to conflict of law principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Marion County, Indiana for the purpose of litigating all such disputes. We operate the Website from our offices in Indiana and we make no representation that Materials included in the Website are appropriate or available for use in other locations.
Dispute Resolution
Any dispute or claim relating in any way to your use of the Website or any feature of the Website will be resolved by binding arbitration, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court, and must follow these Terms of Use as a court would. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS OF USE, YOU AND HICKORY RECOVERY NETWORK ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. Notwithstanding the foregoing, both you and Hickory Recovery Network agree that nothing herein will be deemed to waive, preclude or otherwise limit either party’s right to (a) bring an individual action in small claims court; (b) pursue enforcement actions through applicable federal, state or local agencies where available; (c) seek injunctive relief in a court of law; or (d) file suit in a court of law to address intellectual property infringement claims. Any arbitration hereunder will be governed by the rules of the American Arbitration Association. A party who intends to seek arbitration must first send a written notice of the dispute by certified mail or nationally recognized overnight delivery courier (signature required) or, in the event that we do not have a physical address on file for you and cannot obtain one, by electronic mail. The notice must describe the nature and basis of the claim and set forth the specific relief sought.
Miscellaneous

You may not assign or transfer these Terms of Use or your rights hereunder, ion whole or in part, without our prior written consent.
